The Importance of Filing a Formal Complaint for New Seataoo Claimants: Ensuring Your Rights in the Liquidation Process
The rationale for filing a formal complaint is to demonstrate that we have pending withdrawals and are owed money by New Seataoo Corporation. Filing these complaints is critical, as it formally establishes our claims.
For instance, if the Securities and Exchange Commission (SEC) decides on the issues after Seataoo appeals, and based on their investigation, they confirm that New Seataoo has violated several SEC regulations, the cease and desist order will remain in place. At this point, Seataoo may have the option to appeal the decision to the Court of Appeals to contest the SEC’s findings.
However, if Seataoo does not appeal, the SEC will proceed by collaborating with the Anti-Money Laundering Council (AMLC) or the Bangko Sentral ng Pilipinas (BSP). Their next step would be to process freezing orders for all of New Seataoo’s assets.
Once the assets are frozen, the liquidation process will begin. Only those who have filed formal complaints will be considered when distributing the liquidated assets to affected sellers. This is why filing a formal complaint is crucial—it ensures your claim is included in the liquidation process.
Different OPTIONS AVAILABLE IN FILING A FORMAL COMPLAINT AGAINST SEATAOO
FIRST OPTION: If you are here in the Philippines
The first step in filing a formal complaint is to download the complaint-affidavit template. While this serves as a guide, it is not necessary to fill in every section as a “fill-in-the-blanks” document. Instead, you can structure your formal complaint in paragraph form or as a numbered sequence, clearly outlining your journey with New Seataoo.
Once you’ve completed the document, print and sign it. Afterward, take it to the nearest notary public for notarization. Along with your notarized complaint, prepare to submit supporting documents, such as:
- Wallet Balance Recharge records
- Pending Withdrawals details
- Flash Sales transactions
- Memos from Seataoo (highlighting false statements or delay tactics used by the company)
Once notarized and compiled, submit your complaint to the Securities and Exchange Commission (SEC) along with your evidence to strengthen your case.
SECOND OPTION: If you are Outside the Philippines with Relatives
The second option for filing a formal complaint involves a few additional steps if you cannot personally file it. Start by downloading the complaint-affidavit template. As before, you don’t need to fill out every item. You can write the complaint in paragraph form or number your points to outline your journey with New Seataoo. Once the complaint is completed, print and sign it.
Next, write a Special Power of Attorney (SPA) authorizing a relative to file the complaint on your behalf. This SPA will grant them the legal authority to submit your complaint to the Securities and Exchange Commission (SEC). Make sure to:
- Provide a scanned copy of your ID that includes three signatures.
- Print, sign, and scan the documents, then email them to your relative.
Your relative will take your notarized complaint, along with the necessary evidence such as:
- Wallet Balance Recharge records
- Pending Withdrawals information
- Flash Sales transactions
- Memos from Seataoo (illustrating false statements or delay tactics)
They will then visit a notary public to finalize the documents before submitting them to the SEC on your behalf.
SECOND OPTION: If you are Outside the Philippines without Relatives
The third option for filing a formal complaint follows a similar process but allows you to appoint a trusted leader or another individual to act on your behalf. Here’s how to proceed:
- Download the complaint-affidavit template. You don’t need to fill out every field—your complaint can be written in paragraph form or as a numbered sequence outlining your experience with New Seataoo. After completing it, print and sign the form.
- Draft a Special Power of Attorney (SPA), authorizing someone (such as a leader or trusted person) to file the complaint on your behalf.
- Make sure to include:
- A scanned copy of your ID with three signatures.
- Once all documents are printed, signed, and scanned, email them to your authorized representative.
- Your representative will take the completed complaint and supporting evidence—such as:
- Wallet Balance Recharge records
- Pending Withdrawals details
- Flash Sales transactions
- Memos from Seataoo (highlighting false statements or delay tactics)
- Your representative will then go to the nearest notary public for notarization and submit the documents to the Securities and Exchange Commission (SEC).
If you choose me as your authorized representative, I would only require payment for the notary public fees and the cost of printing the complaint.
